We rent out the gîte on the following basis:
weekend (from Friday 4.00 pm to Sunday 8.00 pm)
long weekend (from Friday 4.00 pm to Monday 11.00 am)
midweek (Monday 4.00 pm to Friday 11.00 am)
week (from Monday or Friday at 4.00 pm until Monday or Friday at 11.00 am)
school holidays: by the week only (from Friday at 4.00 pm until Friday at 11.00 am)

ARTICLE 1: GENERAL PROVISIONS

This contract is a holiday rental agreement. The rental period is an essential condition without which the contract would not have been concluded. The tenant may not take up residence in the rented property.
The property comprises 1 accommodation unit(s) with a capacity of 6 people.

The tenant must comply with the maximum capacity stated in the tenancy agreement. Any breach of this clause may result in the immediate termination of this contract to the detriment of the tenant, in which case the rental amount shall be retained by the landlord.
The tenant must check in on the specified day and at the specified times. In the event of late or delayed arrival, the tenant must notify the landlord.
ARTICLE 2: CONDITIONS FOR ENTERING INTO THE AGREEMENT
Option 2 – Partial advance payment
The tenancy commences upon payment of a deposit of 30% of the price of the stay:
either collected via My Tourist or Elloha’s secure payment system (Stripe) at the time of online booking;
or to be paid into the landlord’s bank account within 7 days of receiving the electronic booking confirmation (voucher)
The balance of the stay (the remaining 70%) must be paid no later than 30 days before arrival by bank transfer to the landlord’s bank account or via the payment link (via our Stripe account) which you will find in our own booking confirmation (sent personally by the landlord) (please check your spam folder)
Any booking made within 7 days of the arrival date is considered late. In this case, the balance for the stay must be paid into the landlord’s bank account upon receipt of the electronic booking confirmation (voucher), i.e. before the start of the stay.
Unless otherwise stated in the booked offer, the price of the stay does not include:
Security deposit: €300.00 (price in words)
Charges: tourist tax 1.00 €/day (per person) or ***.** €/kWh (price in words)
End-of-stay cleaning: ***,** € (price in words)
Bed linen hire: €15 per person (price in words)
Breakfast: ***.** € per person
Other: ***.** € (price in words)
ARTICLE 2a: THE SECURITY DEPOSIT
The security deposit of €300.00 (price in words) must be paid 30 days before the stay by bank transfer to the landlord’s bank account, via the Stripe payment link, or in cash on arrival.
The landlord reserves the right to refuse access to the property if the security deposit is not paid.
The deposit will be refunded within 14 days of departure provided no damage has been caused to the accommodation, outbuildings or surrounding area, and no excessive consumption of electricity, gas or water has been identified.
The deposit serves to cover any debts for which the tenant may remain liable to the landlord upon departure.
In the event of a dispute, the landlord may, at their discretion, withhold the deposit until liability has been clearly established.
If it transpires that the tenant is not liable for the amounts claimed and that the deposit must be refunded in full or in part, the landlord shall be liable to pay statutory interest on the final amount to be refunded.
ARTICLE 3: JOINT AND SEVERAL LIABILITY
Where there are several tenants, the person who made the booking is liable for the debts and claims of all tenants.
ARTICLE 4: LATE PAYMENT
If the landlord does not receive payment within the permitted period, they may, within days of the scheduled payment date, cancel the tenancy by registered letter or email.
This clause does not apply to late bookings.
Any amount owed by the tenant, and not paid days after its due date, shall, by operation of law and without notice of default, accrue interest in favour of the landlord at the statutory monthly interest rate from the due date, with interest for any month commenced being payable for the whole month.
